1. Agreement to These Terms

Welcome to legacybc.org (the Site), operated by Legacy Baptist Church (referred to in these Terms as Legacy Baptist, the Church, we, us, or our). These Terms and Conditions (the Terms) govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms apply to all visitors, users, and others who access the Site.

2. About Legacy Baptist Church

Legacy Baptist Church is a religious nonprofit organization located at 2976 Dallas Acworth Highway, Dallas, Georgia 30132. The Site serves as a public communication channel for the ministry, teaching, events, and outreach activities of the Church.

3. Nature of Website Content

The Site contains sermons, biblical teachings, doctrinal statements, ministry information, event announcements, prayer resources, and other content related to the Church's religious mission. All such content is provided for informational, educational, and spiritual purposes only and represents the theological positions, practices, and perspectives of Legacy Baptist Church.

Content on the Site is not intended to constitute professional advice of any kind, including but not limited to medical advice, mental health advice, legal advice, financial advice, counseling, or therapy. 4. Website Participation Does Not Constitute Membership

Use of the Site, subscription to communications, submission of forms, participation in online events, or any other online interaction with the Church does not constitute membership in Legacy Baptist Church. Church membership is established exclusively through the membership process described by the Church's governing documents and affirmed through in-person participation and affirmation of the Church's statement of faith.

5. User Conduct

By using the Site, you agree that you will not:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
  • Use the Site to transmit any material that is threatening, harassing, defamatory, obscene, sexually explicit, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Attempt to gain unauthorized access to the Site, other user accounts, computer systems, or networks connected to the Site
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission
  • Introduce any viruses, trojan horses, worms, logic bombs, or other malicious code to the Site
  • Interfere with or disrupt the Site or servers or networks connected to the Site
  • Collect or harvest any information from the Site, including user information, without authorization
  • Use the Site for commercial solicitation or advertising without our express written permission

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for conduct that violates these Terms or is otherwise harmful to the Site, the Church, or other users.

6. User Submissions

6.1 Submissions Generally

The Site includes forms and communication channels through which you may submit information such as contact messages, prayer requests, event RSVPs, newsletter signups, and ministry registrations (collectively, User Submissions).

6.2 Grant of License to User Submissions

By submitting a User Submission, you grant Legacy Baptist Church a non-exclusive, royalty-free, worldwide, perpetual license to use, store, reproduce, and distribute the submission solely for the purposes of responding to your submission, administering ministry activities, and carrying out the Church's religious mission. Prayer requests and personal information contained in User Submissions are handled according to our Privacy Policy.

6.3 Your Responsibility for User Submissions

You are solely responsible for the content of your User Submissions. You represent and warrant that:

  • You own or have the necessary rights to the content you submit
  • Your submission does not violate the rights of any third party, including intellectual property, privacy, or publicity rights
  • Your submission does not contain unlawful, threatening, defamatory, or otherwise objectionable material
  • If your submission includes information about another person (including minors in ministry registrations), you have the legal authority to provide that information

7. Intellectual Property

7.1 Church-Owned Content

All content on the Site not attributed to a third party, including but not limited to text, graphics, logos, photos, video recordings of sermons, audio recordings, teaching materials, and the compilation and arrangement of all such content, is the property of Legacy Baptist Church or its content providers and is protected by United States and international copyright, trademark, and other intellectual property laws.

7.2 Permitted Use

You may view, download, and print content from the Site for your personal, non-commercial use, provided that you do not remove or alter any copyright, trademark, or other proprietary notices. You may share sermon recordings, ministry information, and public teaching content for non-commercial religious, evangelistic, or educational purposes with attribution to Legacy Baptist Church.

7.3 Prohibited Use

You may not reproduce, distribute, publicly display, publicly perform, modify, or create derivative works of Site content for commercial purposes without our prior written consent. Unauthorized commercial use of sermon content, teaching materials, music performances, or original Church content is strictly prohibited.

7.4 Third-Party Content

Some content on the Site, including worship music, images, and quoted materials, may be licensed from third parties or used under fair use principles. Such content remains the property of its respective owners and is subject to the licensing terms applicable to that content.

7.5 Trademarks

The Legacy Baptist Church name, logo, and associated marks are trademarks of Legacy Baptist Church. You may not use these marks without our prior written consent.

8. Copyright Complaints (DMCA)

Legacy Baptist Church respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please send a written notice to our designated agent containing the following information required by the Digital Millennium Copyright Act:

  • Your physical or electronic signature
  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing, with enough detail to permit us to locate it
  • Your contact information, including address, telephone number, and email
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

9. External Links

The Site contains links to external websites operated by third parties, including Planning Center Online (our giving platform), YouTube (for sermon videos), social media platforms, and other resources. These links are provided for convenience only. Legacy Baptist Church does not control, endorse, or assume responsibility for the content, privacy practices, or terms of use of any external website. Your use of external websites is governed by the terms and policies of those websites.

10. Online Giving

Online giving to Legacy Baptist Church is facilitated through Planning Center Online, a third-party service. When you click a giving link, you are transferred to Planning Center's servers, and your giving transaction is governed by Planning Center's terms of service and privacy policy. Legacy Baptist Church does not process, store, or have access to your payment card or bank account information.

11. Events and Ministry Participation

Information about events, services, and ministry programs is posted on the Site for informational purposes. Event details, schedules, locations, and participation requirements may change. Registration for or attendance at Church events and ministry programs is subject to any specific terms, waivers, or releases applicable to that event or program, which may be communicated separately.

12. Disclaimers

The Site and all content on the Site are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Legacy Baptist Church disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site. We do not warrant that links to external websites will function or that external content will remain available.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Legacy Baptist Church, its pastors, elders, staff, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your access to or use of the Site, any content on the Site, any User Submissions, or any linked external websites, regardless of the legal theory on which such damages are claimed and regardless of whether we have been advised of the possibility of such damages.

In no event shall the total liability of Legacy Baptist Church to you for all claims arising out of or relating to the Site exceed $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Legacy Baptist Church, its pastors, elders, staff, volunteers, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your User Submissions, your violation of these Terms, or your violation of any rights of any third party.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Paulding County, Georgia, and you consent to the personal jurisdiction of those courts.

16. Religious Organization and Ecclesiastical Matters

Legacy Baptist Church is a religious organization, and its doctrine, practice, membership standards, and internal governance are ecclesiastical matters protected by the First Amendment to the United States Constitution. Nothing in these Terms shall be construed to waive or limit the Church's rights and protections as a religious organization. Disputes concerning religious doctrine, church governance, ministry practices, or ecclesiastical matters are not within the jurisdiction of civil courts and shall be resolved exclusively through the Church's internal governance processes as described in its governing documents.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of Legacy Baptist Church.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and Legacy Baptist Church concerning your use of the Site and supersede any prior agreements between you and us.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the Last Updated date at the top of these Terms and, where appropriate, provide notice through the Site. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
